The rules of the road

1. Acceptance of terms

By registering for or using any Cloudnexis Infotech Private Limited (“Cloudnexis”) service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the services.

2. Account eligibility

You must be at least 18 years old and legally competent to enter into a binding contract under Indian law to open an account. You are responsible for the accuracy of the information you provide.

3. Acceptable use

You agree not to use Cloudnexis services to host, distribute or process:

• Content that is illegal, obscene, defamatory or that infringes intellectual property rights.
• Malware, phishing sites, spam mailers, adult content on shared plans or crypto-mining scripts.
• Content that violates Indian IT Act 2000, Copyright Act 1957 or other applicable law.

We reserve the right to suspend or terminate service, without prior notice, upon breach of the acceptable use policy.

4. Fair-use of unlimited resources

Plans marketed as “Unlimited” are subject to reasonable fair-use limits so that no single customer degrades performance for others. Sustained CPU usage above 25% of a shared core for more than 90 seconds may result in throttling or an upgrade request.

5. Billing and payment

• All plans are billed in advance for the term selected (monthly, quarterly, half-yearly or annually).
• Invoices are due immediately. Services may be suspended after 7 days of non-payment.
• GST is applied as per Indian tax law. Prices are in INR unless stated otherwise.

6. Uptime SLA

We commit to 99.99% monthly uptime on VPS, Dedicated and Cloud plans. If we fall short, you are eligible for service credit as detailed on the plan page. SLA does not cover scheduled maintenance, DDoS attacks, force majeure or issues caused by your own code.

7. Intellectual property

All content on this website — including logos, text, graphics and software — is the property of Cloudnexis or its licensors and is protected by Indian and international copyright laws.

8. Limitation of liability

To the maximum extent permitted by law, Cloudnexis’ liability for any claim relating to the services is limited to the amount you paid us in the three (3) months prior to the event giving rise to the claim.

9. Termination

You may cancel your account at any time from the client dashboard. We may terminate accounts that violate these terms, on 7 days’ notice for material breach or immediately for illegal activity.

10. Governing law

These terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh.
